{"id":6410,"date":"2026-03-03T14:50:55","date_gmt":"2026-03-03T14:50:55","guid":{"rendered":"https:\/\/dev.maryknollsociety.org\/magazine\/?p=6410"},"modified":"2026-04-06T14:53:02","modified_gmt":"2026-04-06T14:53:02","slug":"lawsuit-challenges-trumps-attempt-to-end-birthright-citizenship","status":"publish","type":"post","link":"https:\/\/dev.maryknollsociety.org\/magazine\/lawsuit-challenges-trumps-attempt-to-end-birthright-citizenship\/","title":{"rendered":"Lawsuit Challenges Trump\u2019s Attempt To End Birthright Citizenship"},"content":{"rendered":"\n<p><em>By Kate Scanlon, <a href=\"https:\/\/www.osvnews.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">OSV News<\/a><\/em><\/p>\n\n\n\n<p>WASHINGTON (OSV News) \u2014 The U.S. bishops and a&nbsp;Catholic&nbsp;immigration advocacy group were among those who offered their support to a lawsuit challenging President Donald Trump\u2019s executive order limiting&nbsp;birthright&nbsp;citizenship.<\/p>\n\n\n\n<p>Oral argument in the case, Trump v. Barbara, is scheduled for April 1.<\/p>\n\n\n\n<p>Within hours of returning to the Oval Office in January 2025, Trump signed an executive order seeking to change the longstanding legal interpretation of the 14th Amendment, which states, \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.\u201d<\/p>\n\n\n\n<p>Trump\u2019s order sought to end&nbsp;<a href=\"https:\/\/www.maryknollmagazine.org\/2025\/01\/trumps-birthright-citizenship-order-challenged\/\" target=\"_blank\" rel=\"noreferrer noopener\">birthright&nbsp;citizenship<\/a>&nbsp;for children born in the U.S. to parents without legal status or temporary visa holders. Lawsuits promptly followed.<\/p>\n\n\n\n<p>Previously, the Supreme Court limited the ability of federal judges to issue nationwide injunctions against the order while litigation over it proceeds, but did not directly address the merits of the order itself.<\/p>\n\n\n\n<p>A series of amicus briefs, sometimes called friend of the court briefs, were filed in either support or opposition to the order. Amicus briefs are filed by groups or individuals who are not a party to the case but have an interest in it, asking the court to consider certain arguments.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Church speaks out for the dignity of every child born in the U.S.<\/h2>\n\n\n\n<p>One such brief was filed by the <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/06\/usccb-president-bishops-stand-with-immigrants-in-this-challenging-hour\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Conference of&nbsp;Catholic&nbsp;Bishops<\/a> and the&nbsp;<a href=\"https:\/\/www.cliniclegal.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Catholic&nbsp;Legal Immigration Network Inc.<\/a>, also known as CLINIC.<\/p>\n\n\n\n<p>Their brief argued they were \u201cmotivated by the teachings of the Catholic Church,\u201d including \u201cthe central belief that every person is imbued with an inviolable dignity, and that all human life, created in the image and likeness of God, is sacred.<\/p>\n\n\n\n<p>\u201cIt is through this lens that the Church stands for \u2018treating people humanely, treating people with the dignity that they have,&#8217;\u201d the brief argued, citing comments made by <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/11\/pope-calls-treatment-of-immigrants-in-us-extremely-disrespectful\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pope Leo XIV<\/a> at Castel Gandolfo Nov. 18, 2025. \u201cThese teachings extend to immigrants in the United States without legal status and their American children who were born in the United States.\u201d<\/p>\n\n\n\n<p>\u201cNot only is the principle of birthright citizenship woven into our Nation\u2019s history and Western tradition, but it is also consistent with Catholic teaching,\u201d the brief continued. \u201cBirthright citizenship aligns with the Church\u2019s teaching that humans were created as social beings and that political authority is morally bound to affirm and protect the inherent dignity of every human person in the community. In turn, birthright citizenship reflects the Catholic principle of subsidiarity by recognizing persons as <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/09\/migrants-are-not-enemies-just-brothers-and-sisters-in-need-pope-says\/\" target=\"_blank\" rel=\"noreferrer noopener\">members of the community<\/a> from birth, thereby enabling their participation in civic life and ensuring that state power serves the human person as a social being.\u201d<\/p>\n\n\n\n<p>The brief concluded that \u201cending&nbsp;birthright&nbsp;citizenship&nbsp;lacks historical, legal, and moral support.\u201d<\/p>\n\n\n\n<p>\u201cThe principle of&nbsp;citizenship&nbsp;by birth is firmly rooted in Western legal tradition, enshrined in the Fourteenth Amendment, and reaffirmed by this Court\u2019s precedent,\u201d it said. \u201cIt is equally grounded in Church teachings, which affirms the inherent dignity of every human person, especially the <a href=\"https:\/\/www.maryknollmagazine.org\/2026\/02\/judge-orders-release-of-5-year-old-liam-conejo-ramos-and-his-father\/\" target=\"_blank\" rel=\"noreferrer noopener\">innocent child<\/a>.\u201d<\/p>\n\n\n\n<p>\u201cAs Catholics, our faith compels us to protest laws that deny the dignity of the human person and harm innocent children, particularly when such laws resurrect the very injustices the Fourteenth Amendment was enacted to repudiate,\u201d it added. \u201cAt its core, this case is not solely a question about&nbsp;citizenship&nbsp;status or the Fourteenth Amendment. It is a question of whether the law will affirm or deny the equal worth of those born within our common community \u2014 whether the law will protect the <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/02\/pope-to-us-migration-policies-must-respect-human-dignity\/\" target=\"_blank\" rel=\"noreferrer noopener\">human dignity<\/a> of all God\u2019s children.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Groups and experts supporting the executive order<\/h2>\n\n\n\n<p>A brief in support of the executive order filed by the America First Policy Institute, a think tank that supports Trump-aligned policies, argued, \u201cboth the Executive and Legislative branches have broad constitutional authority over matters of immigration and foreign relations and have extensive powers related to national defense and sovereignty.\u201d<\/p>\n\n\n\n<p>\u201cAccordingly, AFPI believes that each branch has the power and the duty to end birthright citizenship for children of <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/10\/cardinal-mcelroy-calls-for-solidarity-with-migrants-lacking-legal-status\/\" target=\"_blank\" rel=\"noreferrer noopener\">illegal aliens<\/a>, alien tourists, and aliens in the U.S. legally but temporarily,\u201d they argued.<\/p>\n\n\n\n<p>Other <em>amici curiae<\/em>, or those who filed briefs, included members of Congress, state attorneys general, legal organizations, and immigration policy groups.<\/p>\n\n\n\n<p>Another brief from Evan D. Bernick and Jed H. Shugerman, professors who identified themselves as originalist scholars, argued, \u201cFor nearly all of the first 235 years under the Constitution, the&nbsp;citizenship&nbsp;of every child born in the United States to <a href=\"https:\/\/www.maryknollmagazine.org\/2025\/10\/catholic-vigils-for-immigrants-take-place-across-the-country\/\" target=\"_blank\" rel=\"noreferrer noopener\">alien parents<\/a>, with immaterial exceptions, was a given. Then, in 2025, the Trump administration changed course.\u201d<\/p>\n\n\n\n<p>Catholic&nbsp;social teaching on immigration balances three interrelated principles \u2014 the right of persons to migrate in order to sustain their lives and those of their families, the right of a country to regulate its borders and control immigration, and a nation\u2019s duty to regulate its borders with <a href=\"https:\/\/www.maryknollmagazine.org\/2026\/01\/closing-holy-doors-pope-continues-to-call-for-peace-service-mercy\/\" target=\"_blank\" rel=\"noreferrer noopener\">justice and mercy<\/a>.<\/p>\n\n\n\n<p><em>Featured image: A demonstrator holds a placard during a protest outside the Supreme Court May 15, 2025, as the justices heard oral arguments in Trump v.
