(OSV News) \u2014 A federal judge cited two Gospel verses in his order releasing 5-year-old Liam Conejo Ramos and his father, who had been detained by immigration agents in a Minneapolis suburb and sent to a Texas family detention center.<\/p>\n\n\n\n

The sharply worded document also included a picture of the child taken at the time of his capture, as well as a scathing criticism of how the Trump administration<\/a> has conducted its immigration enforcement operations.<\/p>\n\n\n\n

On Jan. 31, U.S. District Judge Fred Biery<\/a> for the Western District of Texas granted the release of asylum-seeker Adrian Conejo Arias and his son Liam (referred to in court documents as \u201cL.C.R.\u201d), finding \u201cthe Constitution of these United States trumps this administration\u2019s detention\u201d of the father and son.<\/p>\n\n\n\n

The family\u2019s lawyer, Marc Prokosch, said the pair, who are from Ecuador, had presented themselves to Texas border offices in December 2024 to apply legally for asylum, according to CNN.<\/p>\n\n\n\n

\u201cThese are not illegal aliens,\u201d Prokosch said. \u201cThey were following all the established protocols, pursuing their claim for asylum<\/a>, showing up for their court hearings, and posed no safety, no flight risk and never should have been detained.\u201d<\/p>\n\n\n\n

Biery upheld the father and son\u2019s protection from unlawful detention under the writ of habeas corpus<\/em> (Latin for \u201cthat you have the body\u201d), which if granted by a judge provides relief from such restraint.<\/p>\n\n\n\n

\u201cThey seek nothing more than some modicum of due process and the rule of law,\u201d wrote Biery.<\/p>\n\n\n\n

An arrest that generated national outrage<\/h2>\n\n\n\n

The pair had been apprehended by Jan. 20 as Liam arrived home from preschool. Speaking to ABC News as they flew home to Minneapolis<\/a> Feb. 1, Adrian Conejo Arias recalled, \u201cWhen we got home, we parked the car and were about to get out. That\u2019s when several agents emerged (from their vehicles) and detained us.\u201d<\/p>\n\n\n\n

ABC News noted the father and son had a pending asylum case, but had not been under a deportation order.<\/p>\n\n\n\n

A bystander image of Liam taken at the time of the arrest \u2014 with the child wearing a bunny hat and standing with his backpack next to a vehicle \u2014 has sparked outrage, particularly amid the respective Jan. 7 and 24 killings of U.S. citizens Renee Nicole Good<\/a> and Alex Pretti by federal immigration-enforcement agents during protests over immigration enforcement<\/a> actions in Minneapolis.<\/p>\n\n\n\n

In his order, Judge Biery included the image of Liam below his signature and added two Scripture citations: Matthew 19:14 and John 11:35.<\/p>\n\n\n\n

The first verse references Jesus Christ\u2019s words of rebuke to his disciples as they sought to prevent little children from approaching him: \u201cLet the children come to me, and do not prevent them; for the kingdom of heaven<\/a> belongs to such as these.\u201d<\/p>\n\n\n\n

The second verse recalls Jesus\u2019 reaction on seeing the tomb of Lazarus, prior to Jesus raising him from the dead: \u201cAnd Jesus wept.\u201d<\/p>\n\n\n\n

Along with the Gospel verses, Biery had strong words for the Trump administration\u2019s hardline immigration policies.<\/p>\n\n\n\n

He said the case of Conejo Arias and his son \u201chas its genesis in the ill-conceived and incompetently-implemented government pursuit of daily deportation quotas, apparently even if it requires traumatizing children.\u201d<\/p>\n\n\n\n

\u201cThis Court and others regularly send undocumented people<\/a> to prison and orders them deported but do so by proper legal procedures,\u201d wrote Biery.<\/p>\n\n\n\n

Judge rebuked government for ignoring the Constitution<\/h2>\n\n\n\n

The judge also chastised \u201cthe government\u2019s ignorance of an American historical document called the Declaration of Independence,\u201d which listed numerous grievances against \u201cwould-be authoritarian\u201d King George III. He cited four of them invoked by the nation\u2019s Founding Fathers against the British ruler: \u201cHe has sent hither Swarms of Officers to harass our People<\/a>\u201c; \u201cHe has excited domestic Insurrection among us\u201d; \u201cFor quartering large Bodies of Armed Troops among us\u201d; \u201cHe has kept among us, in Times of Peace, Standing Armies without the consent of our Legislatures.\u201d<\/p>\n\n\n\n

\u201c\u2018We the people\u2019 are hearing echoes of that history,\u201d warned Biery, who also cited the text of the Fourth Amendment of the Constitution in full on the right of the people to be secure \u201cagainst unreasonable searches and seizures.\u201d It also specifies how warrants are to be issued \u201cupon probable cause.\u201d<\/p>\n\n\n\n

Biery said, \u201cCivics lesson to the government: Administrative warrants issued by the executive branch to itself do not pass probable cause muster. That is called the fox guarding the henhouse. The Constitution requires an independent judicial officer.\u201d<\/p>\n\n\n\n

He also slammed the \u201carcane\u201d U.S. immigration system<\/a> that might see the father and son \u201creturn to their home country, involuntarily or by self-deportation.<\/p>\n\n\n\n

\u201cBut that result should occur through a more orderly and humane policy than currently in place,\u201d Biery said.<\/p>\n\n\n\n
